1. Scope of Application

These Terms and Conditions (“Terms,” “Agreement”) govern the sale of custom products by Albert Management SRL (“Company,” “we,” “us,” or “our”) through the website Albert-coprisedili.it (“Website”). By placing an order with us, you agree to comply with and be bound by these Terms. These Terms are in accordance with EU regulations.

2. Custom Products and Return Policy

  • Custom Products: All products offered by us are custom-made based on your specific requirements. As such, these products are exempt from the right of withdrawal and return as per Article 16(c) of the EU Consumer Rights Directive.
  • No Returns: Given the custom nature of our products, once an order is confirmed and payment is made, cancellations and returns are not permitted.
  • Cancellations: Cancellations are only possible if the product was made incorrectly or not as described in the Order Confirmation. Please note that minor color variations can occur due to differences in device screen calibration, and this does not constitute grounds for cancellation. To help ensure satisfaction, we can send physical samples upon request prior to finalizing the order.

3. Order Process and Payment

  • Order Confirmation: All orders must be confirmed via an Order Confirmation form, which will be sent electronically to the preferred communication method specified by you.
  • Down Payment: We require a down payment of at least 50% of the total order value before we begin processing your order. We will not start production until this down payment is received.
  • Final Payment: The remaining balance must be paid in full before the products are shipped. We will not dispatch any products until we have received 100% payment.
  • Payment Methods: We accept various payment methods, including bank transfer, credit/debit card, and PayPal. All payments must be made in accordance with the payment terms specified in the Order Confirmation.

4. Delivery

  • Delivery Time: The maximum delivery time is 90 days, including bank holidays and weekends, starting from the day after the down payment is received (“Day 1”).
  • Shipping: We will notify you once your order is ready for shipment. Delivery will only occur once full payment has been received. Shipping costs and details will be outlined in the Order Confirmation.

5. Warranty

  • Warranty Period: We provide a 5-year warranty on all our products, covering sun damage and normal material wear and tear.
  • Exclusions: The warranty does not cover:
    • Misfitting due to incorrect installation or measurements provided by the customer.
    • Mechanical damage, including but not limited to cuts, tears, or burns from cigarettes or other sources.
  • Warranty Claims: If you believe your product is covered by the warranty, please contact us with details of the issue and proof of purchase. We will assess your claim and determine the appropriate action, which may include repair or replacement of the product.

6. Liability

  • Limited Liability: Our liability is limited to the purchase price of the product in question. We are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products.
  • Force Majeure: We are not responsible for delays or failures to perform any obligation under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, acts of God, or government actions.

7. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Romania. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Romania.

8. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be communicated to you via the contact information provided and will be effective immediately upon posting on our Website. Continued use of our services following such changes will constitute your acceptance of the revised Terms.
